1. Agreement to Terms

By engaging Green Expectations Landscaping for landscaping services, you agree to be bound by these Terms and Conditions. Please read them carefully before signing any service agreement or contract.

2. Services Provided

Green Expectations Landscaping provides professional landscaping services including but not limited to:

  • Landscape design and installation
  • Drainage solutions
  • Outdoor living space construction
  • Outdoor structures (pergolas, gazebos, pavilions)
  • Walkways and patios
  • Walls and steps
  • Lawn maintenance and care
  • Seasonal cleanup services

3. Estimates and Pricing

All estimates provided are valid for 30 days from the date of issue. Final pricing may be subject to change based on unforeseen site conditions, material cost fluctuations, or changes to the scope of work requested by the client. Any changes to the agreed-upon price will be communicated in writing before proceeding with the work.

4. Payment Terms

Payment terms are as follows:

  • Deposit: A 50% deposit is required before work begins on projects over $5,000
  • Progress Payments: For larger projects, progress payments may be required at specified milestones
  • Final Payment: Due upon completion and acceptance of the work
  • Late Payments: Payments not received within 15 days of the due date will incur a 1.5% monthly interest charge

We accept payment by check, credit card, or electronic transfer. A convenience fee may apply to credit card payments.

5. Cancellation and Changes

Clients may cancel or modify services with the following conditions:

  • Cancellations made more than 48 hours before scheduled work will receive a full refund of any deposit, minus a $100 administrative fee
  • Cancellations made within 48 hours of scheduled work will forfeit 25% of the deposit
  • Changes to the scope of work must be submitted in writing and may affect project timeline and cost
  • Materials already ordered for your project are non-refundable

6. Site Access and Preparation

The client agrees to:

  • Provide clear access to the work area for equipment and personnel
  • Mark or identify any underground utilities, sprinkler systems, or other hidden infrastructure
  • Secure pets during work hours
  • Remove any valuable or fragile items from the work area
  • Ensure that all necessary permits are obtained (Green Expectations Landscaping can assist with this process)

7. Weather and Delays

Green Expectations Landscaping will make every effort to complete work according to the agreed-upon timeline. However, delays due to weather conditions, material availability, or other circumstances beyond our control will not be considered a breach of contract. We will communicate any delays promptly and work to reschedule as soon as conditions permit.

8. Warranty and Guarantees

Green Expectations Landscaping stands behind the quality of our work:

  • Workmanship: We guarantee our workmanship for one year from the date of completion
  • Plants: We offer a 30-day guarantee on all plant material, provided that the client follows our care instructions
  • Hardscape: Hardscape installations are guaranteed for one year against structural defects in workmanship
  • Materials: Manufacturer warranties apply to materials and products used

Warranties do not cover damage caused by client negligence, acts of nature, or unauthorized modifications.

9. Liability and Insurance

Green Expectations Landscaping carries general liability insurance and workers' compensation coverage. We are not responsible for damage to underground utilities, irrigation systems, or other hidden infrastructure that was not properly marked by the client or utility companies. We will take reasonable care to protect existing landscape features, but some collateral impact may be unavoidable during construction.

10. Property Damage

While we take every precaution to protect your property, landscaping work may occasionally result in minor damage to lawns or gardens from equipment or foot traffic. We will make reasonable efforts to repair any damage caused by our work. Clients should report any damage within 48 hours of project completion.

11. Maintenance Responsibilities

Upon completion of the project, the client is responsible for ongoing maintenance unless a separate maintenance agreement is in place. We will provide guidance on proper care and maintenance of installed features. Failure to properly maintain landscaping may void certain warranties.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved, both parties agree to mediation before pursuing legal action. Any legal proceedings will be conducted in the jurisdiction where Green Expectations Landscaping's principal office is located.

13. Intellectual Property

All landscape designs, plans, and drawings created by Green Expectations Landscaping remain the intellectual property of Green Expectations Landscaping. Clients may not reproduce, distribute, or use these designs for other projects without written permission.

14. Photography and Marketing

Green Expectations Landscaping reserves the right to photograph completed projects for marketing purposes, including use on our website, social media, and promotional materials. If you prefer that your project not be photographed or shared, please notify us in writing.

15. Subcontractors

Green Expectations Landscaping may use qualified subcontractors for specialized work. All subcontractors are required to maintain appropriate insurance and licenses. Green Expectations Landscaping remains responsible for the quality and completion of all work performed by subcontractors.

16. Environmental Compliance

Green Expectations Landscaping is committed to environmentally responsible practices. We comply with all local, state, and federal environmental regulations. We properly dispose of waste materials and make efforts to recycle when possible.

17. Changes to Terms

Green Expectations Landscaping reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Existing contracts will remain subject to the terms agreed upon at the time of signing.

By signing a contract or work order with Green Expectations Landscaping, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
